Legislation is now before the Governor of Rhode Island, Gina Raimondo, for any motor vehicle less than 48 months beyond the date of manufacture, that states “no insurance company may require any repairer to use repair specifications or procedures that are not in compliance with the recommendations of the original equipment manufacturer for those parts.” This would apply for any collision damaged part on the vehicle.

As you well know, most OEM repair standards and recommendations do not support the utilization of recycled parts. In this month alone, two automakers have banned the use of recycled parts in repairs for vehicles with advanced driver assistance systems. It is safe to say that if OEMs are asked for their recommendations, they are only going to recommend the use of BRAND NEW parts.   https://www.oem1stop.com/position-statements

If signed into law, this Rhode Island legislation could set a dangerous precedent for other states, including New York, as it sanctions automakers’ campaigns to restrict the re-utilization of recycled parts. This could have serious negative anti-competitive consequences for your business, no matter what state you are in.

ARA and the Automotive Recyclers Association of Rhode Island are still fighting this anti-competitive legislation.  Let’s help them!

3. Tell her that the legislation is bad for the automotive recycling industry, small businesses and consumers because it excludes genuine original pre-owned auto parts.
